Compatibility
Unless specified explicitly in the scope above, the
above update will be tested in the latest version of Internet Explorer,
Firefox, and Safari from a PC based computer. Any testing and needed
validation in a prior version of browser or platform is considered
additional.
Warranties
All services, technology or other deliverables are supplied by EF
strictly on an "as is" and "as available" basis without any express or
implied warranty, guarantee or other assurance of quality, conformity
with specifications, reliability or functionality. Customer accepts all
risk concerning suitability, use, performance or nonperformance. EF
MAKES NO WARRANTY, EXPRESS OR IMPLIED, AND DISCLAIMS ALL IMPLIED
WARRANTIES OF MERCHANTABILITY, TITLE, ACCURACY, INTEGRATION AND FITNESS
FOR A PARTICULAR PURPOSE.
Limitation
of Liabilities
EF IS NOT LIABLE FOR ANY AMOUNT EXCEEDING THE PRICE
PAID BY CUSTOMER FOR SERVICES HEREUNDER GIVING RISE TO ANY CLAIM.
NEITHER PARTY IS LIABLE, WHETHER IN CONTRACT, TORT (INCLUDING
NEGLIGENCE) OR OTHERWISE, FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL
DAMAGES (INCLUDING LOST SAVINGS OR PROFIT, LOST DATA, BUSINESS
INTERRUPTION OR ATTORNEYS FEES) EVEN IF NOTIFIED IN ADVANCE OF SUCH
POSSIBILITY.
Disputes,
Choice of Law
THIS AGREEMENT SHALL BE GOVERNED BY AND CONSTRUED IN
ACCORDANCE WITH THE SUBSTANTIVE LAWS OF THE UNITED STATES AND OKLAHOMA,
AND ANY ACTION SHALL BE INITIATED AND MAINTAINED IN A FORUM OF
COMPETENT JURISDICTION IN SUCH DESIGNATED STATE.
